About the Role

This is an entry-level position. This GS-11 attorney advisor position is located in the Office of the Commissioner for Trademarks, Trademark Examining Groups.

As an Attorney Advisor, you will be responsible for the complete ex parte examination of applications for the registration of trademarks to ensure compliance with the Trademark Act of 1946 and related statutes.

Issues that may arise during the examination include:

  • likelihood of confusion
  • ownership
  • use of the mark in commerce
  • descriptive or generic uses of the mark
  • acquired distinctiveness
  • functionality
  • and/or ornamentation

Your typical work will include:

  • Conducting preliminary review of applications which may pose complex factual and legal questions
  • Analyzing the record
  • Evaluating facts
  • Determining questions of law
  • Recommending approval of a mark for publication for opposition, or draft the final position of the Agency
  • Meeting with counsel in order to resolve issues that arise during examination
  • Preparing cases for ex parte appeal to the Trademark Trial and Appeal Board (TTAB)

Where you will work:

We are under a maximum telework posture due to the COVID-19 pandemic that is scheduled to end May 25, 2022. The position's telework schedule will change when the USPTO moves away from its maximum telework posture. At that time, employees will be expected to report to the physical work site in accordance with the updated status requirements of their supervisor(s) or opt into an applicable telework program. The nature and scope of telework opportunities will be subject to the unit's telework policy, any applicable bargaining unit agreements, and supervisory approval. Employees will be given the opportunity to elect to work from the Alexandria headquarters, from an alternate or home location within the United States (defined as the 50 United States, the District of Columbia, and Puerto Rico), or a combination of headquarters and alternate location.
