Our IP litigation team focuses on large-scale patent litigation for high-technology and life sciences companies, regularly handling cases in federal district courts, the Federal Circuit, the United States Courts of Appeals, and the International Trade Commission. We also handle a range of trade secret, trademark and copyright disputes, which usually involve sophisticated technologies.
Patent Litigation
Our clients benefit from the experience of a deep and broad bench, with more than 50 attorneys devoting their practices to patent litigation. Many members of our team have advanced technical degrees and are registered to practice before the USPTO.
Our team has litigated patent cases in more than 30 federal courts and has prevailed at trials around the country. We have developed particular expertise in the federal courts in California, Delaware, Texas, Virginia, and Wisconsin.
Some firms are just beginning to recognize the International Trade Commission (ITC) as a powerful tribunal for resolving multinational patent disputes. We have been navigating the unique procedural rules of the ITC for decades, achieving results for our clients, whether initiating investigations or responding to them. In fact, we have successfully tried some of the largest cases in the history of the tribunal, including an eight-patent, 13-week case in which the Commission found all of our client's eight patents valid, six infringed, and put an exclusion order in place. The ruling was affirmed by the Federal Circuit.
We have extensive experience in litigating the antitrust aspects of patent disputes. In addition to handling the antitrust counterclaims often brought in patent litigation in the electrical/mechanical area, we advise pharmaceutical clients on issues relating to the drug life cycle and ANDA filings by generic drug companies. We also litigate both the antitrust and patent cases that arise out of the ANDA process. Our intellectual property litigators frequently partner with our nationally recognized antitrust group, recently named one of the top eight antitrust practices in the United States by Chambers Global.
Trade Secret and Non-Compete Litigation
We handle trade secret and non-compete disputes for a variety of sophisticated technology companies across the country. We were lead counsel in one of the leading cases on non-competes in Pennsylvania. Our Silicon Valley IP attorneys have, for decades, represented numerous Silicon Valley companies in high-profile cases involving employee mobility.
We also help our clients evaluate and implement creative strategies to protect their trade secrets and confidential information. Our trade secret counseling program includes the development of employment contracts, negotiation of confidentiality agreements with employees, suppliers and customers, and finding creative ways for our clients to strengthen their systems and security measures.
Trademark and Copyright Litigation
Dechert's team of U.S. and U.K-based litigators helps businesses protect their trademarks and copyrights in litigation and pre-litigation disputes. We protect our clients' rights in federal and state courts, before the Trademark Trial and Appeal Board, the U.S. Copyright Office, the U.S. Patent and Trademark Office, and in jurisdictions around the world. We also promote clients' interests before international tribunals such as the Internet Corporation for Assigned Names and Numbers (ICANN) and the World Intellectual Property Organization (WIPO).
